Bioethics and law in the Pavesi case: a legal-penal analysis of illegal organ removal from children in Brazil and the (in)applicability of the Statute of the Child and Adolescent

This article focuses on the study of the Pavesi Case, which took place in Poços de Caldas, Minas Gerais, in 2000, and is considered a paradigmatic case of the illegal removal of organs from a child in Brazil. The research aims to analyze, from a criminal law and bioethical perspective, the implications arising from this case and to discuss the (in)applicability of the Statute of Children and Adolescents (ECA) in ensuring the full protection of children against illicit practices involving organ removal. The general objective is to examine how the interface between Bioethics and Law contributes to understanding the normative and institutional shortcomings revealed by the case, as well as the limits and possibilities of the ECA in addressing such conducts. The methodology will be qualitative, adopting a legal-documentary and bibliographic approach, based on the analysis of legislation, doctrine, jurisprudence, and official documents, along with a chronological and critical reconstruction of the case. Expected results include a deeper reflection on the effectiveness of Brazilian norms in combating the illegal removal of children’s organs and the development of proposals to strengthen criminal accountability, medical ethics, and the full protection of children and adolescents.
